Botswana Gambling Age: What the Gambling (Amendment) Bill of August 2026 Changes and When

The Botswana gambling age is 21 today and becomes 18 once the Gambling (Amendment) Bill No. 15 of 2026, passed by Parliament on 13 August 2026, is brought into force by a notice from the Minister. Until that gazette the Gambling Authority's licensees verify 21 at sign-up, and the new age has no effect on an account.

What the Bill does

The Gambling Act set the legal age at 21, the highest in southern Africa, and the Gambling (Amendment) Bill No. 15 of 2026 lowers it to 18. Parliament passed the Bill on 13 August 2026, and its text, published by Parliament, leaves the commencement to a date the Minister fixes by notice in the Gazette.

The Bill sits beside the Gambling Authority's other 2026 work: a notice inviting applications for digital gaming licences, and the bookmaker and betting licensee list that the Authority publishes.

Nothing in the Bill changes the tax position, which the 2026 Income Tax Act settled from 1 July 2026 with no withholding on a punter's winnings.

What the Botswana gambling age means at sign-up today

A licensee on the Gambling Authority's list checks the Botswana gambling age against an Omang or passport at registration. An applicant under 21 is refused, by the sportsbook and by its casino lobby alike, until the commencement notice is published.

The ranked brands, 22Bet and Melbet for Botswana, take customers under offshore licences and apply the age their own terms set, with no Botswana desk behind the account.

A punter who turns 18 before the notice gains nothing at a licensee until it appears; one who is 21 today sees no change at all.

The Gambling Authority's prevention and rehabilitation programme covers licensees' customers at any age the law allows.

The pula arithmetic that stays the same

A P100 stake at 3.00 returns P300 in full, because no withholding applies to winnings under the Income Tax Act 2026 and tax falls on the operator. A 2.00 in Botswana pays 2.00, where it pays 1.85 across the border in Zambia after that country's levy and 1.75 in Zimbabwe.

Welcome offers are unchanged by the Bill: 22Bet's 100% match and Melbet's pula value of US$100 follow the terms each operator publishes, with the deposit floor and rollover printed on the Botswana home page. Orange Money and bank routes carry no new charge.

The age is the only variable waiting on a date.

What changed on the Botswana home page

The legal age reads 21 with a note on the Bill and its passage date, and it will read 18 on the day the Gazette notice is published. The licensee list and the tax section were corrected after the Income Tax Act took effect in July.

A Motswana punter aged 18 to 20 who reads of the Bill should wait for the notice rather than a licensee's sign-up form, which will refuse the application until then. The ranked offshore brands apply their own age terms and answer to no Botswana desk.

The two questions below are the ones readers have asked most since Parliament voted.

Questions about the age change

Can an 18-year-old bet in Botswana today?

No. The Bill lowers the age to 18, but the change applies only from the date the Minister gazettes, and until that notice 21 remains the legal age. Licensees verify it at sign-up, and the ranked offshore brands apply the age their own terms set.

Is there a tax on winnings in Botswana?

No. Since 1 July 2026 the Income Tax Act 2026 has applied, and it withholds nothing from betting winnings: P1,000 won is P1,000 paid, whether the bookmaker is a licensee or an offshore brand. Tax falls on the operator.
